April 18, 2003 (Whitestown, New York) ? Peeing in a coffee pot could cost millions.

Eight people are suing for $600,000 apiece, in the case of a __PO'ed__ office worker who peed in the pot.

Holly Jones pleaded guilty to misdemeanor count of creating a criminal nuisance.

State police say a hidden camera caught Jones urinating in the coffee at Robinson Aviation in upstate New York.

Now, her co-workers are suing Jones and their employer.

The suit charges the coffee-drinkers were made sick by the contaminated java. The court action also claims the company should have done more to protect its employees.

According to police, Jones was angry about being passed over for a promotion.

I would sue the company for breach of privacy and then on top of that damages for selling porn without a signed release and affidavit of age. I would also sue the co workers for watching a movie made without permission of the actress and for distress and duress.

I see a flaw here already.

Drinking urine in and of itself will not make you sick. Several tribes around the world do it as a part of rituals. If they got sick, it was probably a mental response to finding out they had beed drinking pee. Repulsion got the best of them, not physical reaction. And the heat from the coffee would kill any microbes.

I don't think the lawsuit is going to yield much other than a slap on the wrist, and a interesting blooper on her criminal record.

If you can show damages, you can sue.

That's the weak part of this case. Damages
may be nominal at best. In any case, it will cost
a lot of money to run the trial.

Physical damages (medical evidence required).

Mental damages (psychologist's evidence required).

All damages proceed on the basis that one takes one's
victim as one finds them, anticipating that among them,
somebody may have a terribly adverse reaction. It's a
thin skin rule or something like that.

You're right. The "inventor" of the macrobiotic diet, a Japanese guru of some sort, used to drink his own urine when getting up in the morning.

No: Physical losses includes damages for pain and suffering.

There is a crossover here where you become ill just thinking
about what you drank.

This suit is based on the venerable common law of tort.
A tort is a wrong done for which the law offers compensation.

I'd be very surprised if there wasn't precedent for piss.

Piss is ubiquitous.

Quebec is a Napoleonic Code area and so is Louisiana as I
understand it. Perhaps there, you can spike a co-worker's
coffee and get away with it.


I find it repulsive and would award punitive damages as
there is intent.
